These Website Terms of Use (the “Terms”) govern your access to and use of the EducArte website at https://www.educarteinc.org, including any pages, forms, features, and content made available through it (collectively, the “Site”).

The Site is operated by EducArte Incorporated, doing business as EducArte (“EducArte,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply to use of the Site. Participation in an EducArte class, event, performance, residency, workshop, camp, or other program may also require separate registration forms, releases, policies, or agreements. If a program-specific agreement conflicts with these Terms, the program-specific agreement will control for that program.

  1. Use of the Site

You may use the Site for lawful, personal, and noncommercial purposes, including learning about EducArte, registering for programs or events, making donations, purchasing tickets or merchandise where available, and contacting us.

You agree not to:

  • Use the Site in violation of applicable law or regulation.
  • Interfere with the security, operation, or availability of the Site.
  • Attempt to gain unauthorized access to the Site, its systems, accounts, or data.
  • Use the Site to transmit malware, spam, fraudulent communications, or harmful or unlawful material.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Copy, scrape, reproduce, distribute, or exploit Site content for commercial purposes without our prior written permission, except as permitted by law.
  • Use automated tools, bots, spiders, or data-mining tools to access or collect information from the Site in a manner that burdens, disrupts, or bypasses the Site’s intended operation.

We may suspend or restrict access to the Site when reasonably necessary to protect the Site, our community, our rights, or other users.

  1. Children and Family Use

EducArte provides arts education and cultural programming that may serve children and youth. Parents or legal guardians are responsible for registering minors for programs and for providing any consents, emergency information, releases, or permissions requested in connection with a program.

Minors may use publicly available portions of the Site with a parent’s or legal guardian’s supervision. A minor should not independently submit personal information through the Site where parental or guardian consent is required by law or by EducArte’s program procedures.

  1. Intellectual Property

Unless otherwise indicated, the Site and its content—including text, photographs, video, audio, graphics, logos, program materials, designs, and other materials—are owned by EducArte or used by EducArte with permission and are protected by applicable intellectual-property laws.

You may view, download, or print reasonable portions of the Site for your personal, noncommercial use, provided that you keep all copyright, trademark, and other proprietary notices intact. You may not otherwise reproduce, modify, publish, distribute, publicly display, create derivative works from, or commercially use Site content without EducArte’s prior written permission or the permission of the applicable rights holder.

EducArte’s name, logos, and marks may not be used in a manner that suggests sponsorship, affiliation, or endorsement without our prior written permission.

Nothing in these Terms transfers ownership of any intellectual-property rights to you.

  1. Registrations, Tickets, Donations, and Purchases

The Site may allow you to register for programs or events, make a charitable donation, purchase tickets, or purchase merchandise or services. Availability, fees, deadlines, cancellation terms, and other conditions may vary by offering and will be stated on the applicable registration, ticketing, donation, or purchase page.

You agree to provide accurate, complete, and current information when completing a transaction or registration. You represent that you are authorized to use the payment method you provide.

Payments may be processed by third-party providers. EducArte does not store full payment-card information unless expressly stated otherwise. Your transaction may also be subject to the terms and privacy policies of the payment processor, ticketing platform, registration platform, or other third-party provider.

Donations are voluntary charitable contributions and are generally nonrefundable except where required by law or in the event of a processing error. Ticket, registration, merchandise, or other purchase refunds and transfers are governed by the applicable offering’s posted policy or terms.

EducArte may cancel, reschedule, relocate, modify, or substitute elements of a program or event when reasonably necessary because of weather, safety, public-health conditions, venue availability, artist or instructor availability, force majeure, or other circumstances outside our reasonable control. When feasible, EducArte will communicate material changes using the contact information provided at registration or purchase.

  1. Program Participation and Community Conduct

EducArte is committed to creating welcoming, respectful, and safer spaces for artistic learning, cultural exchange, and community participation. Participants, families, audience members, volunteers, and visitors are expected to follow applicable program rules, venue rules, and reasonable staff instructions.

We may deny or end participation in an activity when conduct is unsafe, unlawful, discriminatory, harassing, threatening, materially disruptive, or otherwise inconsistent with the safety and well-being of participants, teaching artists, staff, volunteers, and guests. Except as required by law or stated in a specific program policy, removal for conduct-related reasons does not create a right to a refund.

Program-specific safety requirements, releases, medical/emergency information, photo and video permissions, pickup procedures, and other requirements will be addressed through the applicable registration materials or program documents.

  1. Photos, Video, and Participant Materials

EducArte may photograph, record, or document certain programs, events, and performances. Where EducArte seeks permission to use an identifiable participant’s name, image, likeness, voice, performance, or work for promotional, educational, archival, fundraising, or reporting purposes, the applicable consent or media-release form governs that use.

Do not assume that these Site Terms alone authorize EducArte to use a participant’s image, recording, performance, or creative work. For minors, a parent or legal guardian must provide any required consent.

If you submit a testimonial, feedback, photograph, video, or other material to EducArte for possible publication, you represent that you have the necessary rights and permissions to submit it. Unless a separate written agreement states otherwise, you grant EducArte a nonexclusive, royalty-free, worldwide license to use, reproduce, display, adapt for formatting or accessibility, and share that material in connection with EducArte’s mission and communications. We will not use your material in a manner that is materially inconsistent with the purpose for which you submitted it.

  1. Third-Party Sites and Services

The Site may include links to third-party websites, services, social-media platforms, registration tools, ticketing platforms, payment processors, video platforms, or other resources. These third parties operate independently from EducArte. We do not control and are not responsible for their content, availability, security, privacy practices, products, services, or terms.

Your use of a third-party site or service is governed by that third party’s terms and policies. Review them before providing information or completing a transaction.

  1. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how EducArte may collect, use, retain, and share personal information. The Privacy Policy is incorporated into these Terms by reference.

  1. Accessibility

EducArte strives to make its website and programs accessible to the broadest possible community. If you encounter a barrier when using the Site or need assistance accessing information or registering for an offering, please contact us at educarteinc.org/contact. We will make reasonable efforts to provide assistance and consider accommodation requests.

  1. Site Availability and Changes

We may update, change, suspend, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, uninterrupted, secure, error-free, or free of harmful components.

We may update these Terms from time to time. The revised version will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after the updated Terms are posted means that you accept the revised Terms.

  1. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, EducArte disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We try to keep Site information accurate and current, but we do not guarantee that all content is complete, accurate, reliable, or current. Program schedules, artists, instructors, locations, fees, availability, and other details may change. Please contact EducArte if you need confirmation of a material detail before relying on it.

Nothing in these Terms limits rights or protections that cannot lawfully be limited or excluded.

  1. Limitation of Liability

To the fullest extent permitted by law, EducArte and its directors, officers, employees, volunteers, teaching artists, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, EducArte’s total liability for claims arising out of or relating to the Site will not exceed the amount you paid directly to EducArte, if any, for the specific Site-related transaction giving rise to the claim during the six months before the event giving rise to the claim.

This section does not limit liability that cannot be limited under applicable law.

  1. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless EducArte and its directors, officers, employees, volunteers, teaching artists, agents, and affiliates from claims, damages, liabilities, costs, and expenses—including reasonable attorneys’ fees—arising out of your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.

  1. Governing Law and Venue

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Site that is not resolved informally will be brought in the state or federal courts located in Maryland, unless applicable law requires otherwise. You and EducArte consent to the jurisdiction of those courts.

Nothing in this section prevents either party from seeking appropriate equitable or injunctive relief to protect intellectual-property rights, confidential information, or Site security.

  1. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

These Terms, together with the Privacy Policy and any applicable program, registration, ticketing, donation, or purchase terms, form the agreement between you and EducArte regarding your use of the Site.
